Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Epilogue Group, LLC (“Epilogue,” “we,” “us”), the operator of SpeakUp at speakup.epiloguecomms.com (the “Service”). By creating an account or using the Service, you agree to these Terms on behalf of yourself and, if you use SpeakUp for an organization, on behalf of that organization.
01The Service
SpeakUp helps nonprofits and NGOs audit their public messaging, measure media coverage, and discover PR and visibility opportunities.
The Service is currently offered without charge during its early-access period. We may introduce paid plans in the future; if we do, we will give existing customers clear advance notice and the choice to continue or export their data and leave.
02Accounts and organizations
You must provide accurate account information and keep your credentials secure. You are responsible for activity that occurs under your account.
Organizations in SpeakUp have role-based access (admin, editor, viewer). Admins are responsible for managing who has access to their organization and at what level, and for the actions of the members they authorize.
03Your content
You retain ownership of the content you submit to SpeakUp — mission statements, press materials, and other text. You grant Epilogue a limited license to host and process that content solely to provide the Service to you.
You are responsible for having the necessary rights to the content you submit.
04Automated analysis — important limits
SpeakUp’s outputs — sentiment scores, messaging themes, gap reports, and opportunity suggestions — are automated analyses intended to inform your team’s judgment. They may contain errors or omissions, and media coverage data gathered from public sources may be incomplete.
The Service does not provide professional communications, legal, or fundraising advice, and you should verify important information before acting on it.
05The public demo
The live demo uses fictional sample data to illustrate the product. Nothing you do in the demo is saved, and demo content does not describe any real organization.
06Third-party content and services
Some features find and display publicly available content from third-party platforms — for example, news coverage and public YouTube videos that mention your organization. That content belongs to its creators and publishers; SpeakUp links to the original source.
When you use features that display YouTube content, you also agree to be bound by the YouTube Terms of Service, available at https://www.youtube.com/t/terms.
07Acceptable use
You agree not to: use the Service in violation of law or others’ rights; attempt to access data belonging to another organization; probe, disrupt, overload, or reverse-engineer the Service; or use the Service to develop a competing product.
We may suspend or terminate accounts that violate these rules.
08Our intellectual property
The Service — including its software, design, and branding — belongs to Epilogue Group, LLC and its licensors. These Terms do not grant you any rights in the Service other than the right to use it.
09Termination
You may stop using the Service at any time. Organization admins can permanently delete their organization and all of its data from Settings.
We may suspend or terminate access for violations of these Terms. Sections of these Terms that by their nature should survive termination (such as intellectual property, disclaimers, and limitations of liability) survive.
10Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
11Limitation of liability
To the maximum extent permitted by law, Epilogue Group, LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, arising from your use of the Service.
Our total aggregate liability for all claims relating to the Service is limited to the greater of one hundred U.S. dollars ($100) or the amounts you paid us for the Service in the twelve months before the claim arose.
12Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules.
13Changes to these Terms
We may update these Terms as the Service evolves. When we do, we will change the “Last updated” date above, and for material changes we will notify organization admins by email before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance.
